This product trial agreement is by and between Aquamonitor Pty Ltd and any approved trial volunteers. Before you may take part in the trial you must agree to the following terms and conditions.

1. Term. This Trial Agreement shall commence as of the date on which the Aquamonitor trial product has been received by the trial volunteer and, unless terminated earlier in accordance with this Agreement or extended agreement of the parties, shall automatically terminate at 11:59 p.m. on the sixtieth (60th) day of the Trial Period. Any provision of this Trial Agreement intended to survive the termination of this Agreement shall survive termination of this Trial Agreement and continue in full force and effect. At the end of the Trial Period, the product become the property and responsibility of the trial volunteer, or the volunteer shall return the product and related materials, at its own expense, to Aquamonitor Pty Ltd. The trial product is a prototype and final products available to the market may differ in style, price and function.
2. Ownership and Nondisclosure. Volunteers acknowledge and agree that for the period of the trial, Aquamonitor Pty Ltd is the owner of the product and except as set out above, this Trial Agreement does not grant to the volunteer any right, title or interest in or to this product, including in or to any intellectual property or proprietary right in or to the product, and volunteer shall not obtain or claim any right, title or interest in or to the product, or any portion thereof, or any intellectual property or proprietary right therein. Volunteers further acknowledge and agree that the product embodies confidential information and trade secrets of Aquamonitor Pty Ltd or the owner and volunteers shall not disclose any portion of the products make to any third party.
3. Limited Use.  Volunteers shall not modify the product in any way and volunteers shall not copy, sell, rent, sublicense, give away or otherwise transfer the product or any portion thereof for the duration of the trial period. Volunteer further agrees that it shall not reverse-compile, disassemble or reverse-assemble the Product. Volunteers shall not rely upon the product for business applications during the Trial Period and volunteers shall be solely responsible for any costs incurred by doing so during the Trial Period.
4. Availability. Aquamonitor Pty Ltd does not guarantee that equipment will be available for shipping immediately. Where equipment is not available on date requested by volunteer, Aquamonitor will arrange a more suitable date and time with the volunteer.
5. Privacy and Collected Information. Aquamonitor Pty Ltd is committed to ensuring the privacy of user’s personal information. At no time will Aquamonitor Pty Ltd disclose personal information of volunteers to third parties, nor will personal information be linked to results of the study.
6. Feedback. Customer feedback, whether good or bad is greatly appreciated so please feel free to contact us either by phone, email, fax or customer feedback form at any time. As a condition of the product trial, volunteers agree to be contacted by a representative of Aquamonitor Pty Ltd by phone, post or email for the collection of usage and market research information.
7. Technical Support Services. For the trial period technical support is to be made available to all volunteers to provide assistance with installation and usage of the product. These services include a reasonable number consultations and announcements via phone and email but do not include physical installation. Once the product has been shipped, Aquamonitor Pty Ltd takes no responsibility for physical maintenance, fitting or upkeep of the product.
8. Trial Questionnaires. Participants are required to complete to the best of their ability and return (if required) Aquamonitor’s short questionnaire supplied with the Aquamonitor unit upon the completion of their trial period. Failure to do so is in breach of these terms and conditions and participants who do not provide Aquamonitor with a completed questionnaire will be billed for the 50% discount they received when signing up to the trial program.
9. DISCLAIMER. AQUAMONITOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING ANY IMPLIED WARRANTY OF FUNCTION OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PRODUCT PROVIDED. Without limiting any other provision of this Trial Agreement, Aquamonitor shall not be liable for any direct, special, indirect or consequential damages resulting from the installation, use performance or nonperformance of the product during the Trial Period. It is the responsibility of the participant to ensure that their water meter is compatible with the Aquamonitor and information is provided to enable participants to do so, Aquamonitor Pty Ltd will not make refunds on devices due to incompatibility.
